Advisory opinion request from former Louisiana Department of Transportation and Development.(DOTD) employee, James Lipscomb, regarding whether the Code of Governmental Ethics (Code) would prohibit him from contracting to provide appraisal services to other public agencies.
Facts:
Mr. Lipscomb requested an advisory opinion regarding whether the Code would prohibit him from contracting to provide appraisal services to other public agencies within two years of the termination of his public service with the DOTD. He was hired as a Review Appraiser for DOTD in 2012 and served as the Chief Appraiser from March 2015 until June 2016. He terminated his public service with DOTD in March of 2017. Mr. Lipscomb stated that he does not intend to apply for any appraisal work from DOTD until after March of 2019. Further, he stated that he did not perform appraisals while he was employed at DOTD.
Law:


La. R.S. 42:1121A(1) prohibits a former elected official, for a period of two years following the termination of his public service as an elected official serving in such agency, from assisting another person for compensation, in a transaction, or appearance in a connection with a transaction, involving that agency or rendering any service on a contractual basis to that agency.


La. 42:1121B(1) prohibits a public servant, for a period of two years following the termination of his public employment, from assisting a person for compensation in a transaction in which he participated or from rendering any service which such former public employee rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of the agency with which he was formerly employed.



Recommendations:
Adopt draft advisory opinion.
