RE:
Request that the Board reconsider waiving the $480, $60, $780 and $600 campaign finance late fees assessed against Aylin Acikalin Maklansky, a candidate for Council Member, District A, Orleans Parish, in the October 14, 2017 election, whose 2017 Supplemental campaign finance disclosure report and three special reports were filed 8, 1, 13, and 16 days late, respectively.
Facts:
Aylin Acikalin Maklansky states this was her first attempt to run for public office. She states she hired a campaign finance compliance consultant, who she relied on to advise her on reporting requirements and how to file reports. Regarding the in-kind donations, upon information and belief, she states the vendors did not invoice the campaign until after the election as to the value of the donations. At the same time, she states the 2017 Supplemental report was due, she was preparing for a very important trial on several issues in her personal child support case. As soon as she realized the error, she states she filed the report within a reasonable time of the filing deadline.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Affirm the Board's prior decision to suspend all but $200 based on future compliance for two Special reports ($780 and $600); and, decline to waive for the Special report ($60) and the 2017 supplemental report.
