RE:
Advisory opinion request concerning post-employment restrictions that would apply to Charles Larroque after his retirement from the Council for the Development of French in Louisiana.
Facts:
Charles Larroque retired as executive director of the Council for the Development of French in Louisiana (CODOFIL) on January 1, 2018. One of his duties as executive director of CODOFIL was to oversee activities related to the role of the French language in cultural tourism in Louisiana. Now that Mr. Larroque is retired, he is considering working as a paid consultant for private entrepreneurs interested in creating tools that may facilitate the development of Louisiana's cultural economy based on the practical applications of the French language. Any company for which Mr. Larroque would act as a consultant would not be regulated by CODOFIL or receive money from or contract with CODOFIL. The only foreseeable interaction with CODOFIL would be for the purpose of sharing the company's concept and seeking CODOFIL's approbation of the venture since it fits with its mission of bringing Louisiana French to the 21st century global economy.
Law:
La. R.S. 42:1121A prohibits a former agency head, for a period of two years following the termination of his public service as the head of such agency, from assisting another person, for compensation, in a transaction, or in an appearance in connection with a transaction, involving that agency or rendering any service on a contractual basis to or for such agency.
Recommendations:
Adopt the proposed advisory opinion.
