Advisory opinion regarding the Village of Forest Hill's Gas Superintendent working as a gas operator on a contractual basis for the Town of Glenmora.
Facts:
Herman H. Spiller is the Gas Superintendent for the Village of Forest Hill. The Town of Glenmora does not have a certified gas operator and has asked Mr. Spiller for assistance. Mr. Spiller would provide these services on a contractual basis as needed. The Village of Forest Hill does not require him to provide services for the Town of Glenmora. He would be performing the same duties for both governmental agencies.
Law:
Section 1111C(1)(a) of the Code prohibits a public servant from receiving any thing of economic value for any service, the subject matter of which is devoted substantially to the responsibilities, programs, or operations of the agency of the public servant and in which the public servant has participated.
Recommendations:
Adopt proposed advisory opinion.
