Advisory opinion request from Gail Howell, Administrator of Caddo-Shreveport Sales and Use Tax Commission (Tax Commission), regarding whether there are any conflicts of interest with Kelvin Johnson serving as a field representative for the Tax Commission while being employed by Home Depot. |

Mr. Johnson unloads freight and stocks the Home Depot store in Caddo Parish. He performs his work for Home Depot outside of his normal working hours for the Tax Commission. One of his duties as a field representative for the Tax Commission is to contact businesses with delinquent taxes after working with the collections manager and/or receivables coordinator. The Home Depot in Caddo Parish has a mailing address in Illinois. Any correspondence regarding delinquent taxes would be sent to this address.

La. R.S. 42:1112B(3) provides that no public servant, except as provided in R.S. 42:1120, shall participate in a transaction involving the governmental entity in which, to his actual knowledge, any person of which he is an officer, director, trustee, partner, or employee has a substantial economic interest.
