Advisory opinion request concerning post-employment restrictions that would apply to Glenn Ledet following the termination of his employment with the State of Louisiana's Coastal Protection and Restoration Authority.
Facts:
Glenn Ledet seeks an advisory opinion concerning post-employment restrictions that would apply to him following the termination of his employment with the State of Louisiana's Coastal Protection and Restoration Authority (CPRA). Mr. Ledet was employed at CPRA from May 2015 until June 1, 2018. From May 2015 until July 2017, he worked in the Engineering Division as an Engineering Supervisor for various projects under the direction of Rudy Simoneaux, Engineering Manager, and Jerry Carroll, Chief of Engineering. He then worked from July 2017 until June 1, 2018 as the Assistant Administrator of the Operations Division. In this role, Mr. Ledet helped manage some of the emergency operations and flood protection functions for CPRA and functioned as a multi-disciplinary resource with roles in engineering operations, flood protection and construction. He provided support to the Operations Chief for administrative and technical guidance to three Regional Program Managers who are responsible for programs and projects for a defined geographic region to ensure projects remain on schedule and under budget.

Mr. Ledet is currently employed with APTIM, a consulting firm that performs coastal, civil engineering and environmental work in twelve countries worldwide. APTIM currently works for CPRA on numerous efforts and will continue to seek future opportunities to provide services. His new role with APTIM is as Senior Client Program Manager. In this position, he is helping APTIM manage clients, develop relationships and lead associated teams in successfully delivering a safe and quality product or service to the client. He will be interacting with clients and help to organize and contribute to business development activities. He will also be helping to direct preparation of work plans, supervise project teams, and manage project scope, budget and schedule.

Mr. Ledet seeks guidance as to which services he can provide to CPRA as a current employee of APTIM, with the exception of services that he provided on previous projects as an employee of CPRA. Specifically, he would like to work on CPRA's upcoming Outcome-Based Performance Contracting project. This upcoming project will use an alternative project delivery method, known as outcome-based performance contracting, for use by CPRA to award a contract to finance, design, construct, and monitor a coastal restoration project. The current Request for Statement of Interest and Qualifications (RSIQ) will allow CPRA to evaluate and select qualified Proposers who will be invited to submit proposals to a subsequent Request for Proposal (RFP) for full delivery of marsh creation and/or ridge restoration projects. This is a new project method that was not formally approved until the 2017 legislative session. This method has not been used before by CPRA, and this is the first solicitation of its kind. Mr. Ledet did not have any role in developing or providing services related to this solicitation.

Law:
Section 1121B of the Ethics Code prohibits a former public employee, for a period of two years following the termination of his public employment, from assisting another person, for compensation, in a transaction involving the agency of the former public employee, in which the public employee participated at any time during his public employment. Additionally, Section 1121B prohibits a former public employee, for a period of two years following the termination of his public employment, from rendering the same service which he rendered during his public employment on a contractual basis to, for, or on behalf of his former agency.
Recommendations:
Adopt the proposed advisory opinion.
