Advisory opinion regarding whether Krystal Degueyter, an employee of the Acadiana Regional Development District (ARDD), may be assigned to a special project which includes contracting with Acadiana Works, Inc., the Director of which is Ms. Degueyter's step-father.
Facts:
Krystal Degueyter is an employee of AARD. Krystal Degueyter is being considered for assignment to a special project involving AARD, the Local Workforce Investment Board #40, Acadiana Works, Inc. and the Louisiana Workforce Commission. A National Emergency Grant was awarded to the Louisiana Workforce Commission to provide training and technical assistance for dislocated workers affected by the B.P. Gulf Oil spill.



Krystal Degueyter is the step-daughter of the Director of Acadiana Works, Inc. Acadiana Works, Inc. will be contracting with AARD to assist on this project.







Law:
Section 1113A prohibits a public servant, a member of his immediate family or a legal entity in which either owns a controlling interest, from bidding on or entering into a contract, subcontract or transaction that is under the supervision or jurisdiction of the public servant's agency.


Section 1102(13) defines "immediate family" as including a public servant's children, spouses of his children, his brothers and their spouses, his sisters and their spouses, his parents, his spouse, and the parents of his spouse.



BD Dockets 06-449, 06-778, and 06-994 all held that step-children are not immeidate family members.

Recommendations:
Adopt proposed advisory opinion.
