Waiver request submitted by Cassandra Marie Anderson, with the Workforce Investment Board/ Area #20, regarding $400 and $1,500 late fees assessed for filing her 2016 and 2015 Tier 2.1 annual pfds 8 and 116 days late, respectively.
Facts:
Ms. Anderson has late fee orders for 2015 and 2016. She states that she was required to be on the WIA Board as part of her job with Motivation, Education and Training, Inc. (MET). She timely filed her 2014 PFD. In January 2016, she was informed that she was no longer required to be on the WIA Board. Her positions with MET ended on July 15, 2016. She had no further contact with the WIA Board or MET. She did not receive the PFD forms mailed to MET in 2016 and had no knowledge of her requirements to file until she spoke with Vivien Head on February 27, 2018. She received the forms and filed them on the same date. She was out of state when the late fee notice was delivered on June 7, 2018. Documentation supports her claims. Her request for waiver was timely received.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
2015 - Suspend all based on future compliance with the reporting requirements under the Code of Ethics.

2016 - Decline to waive.
