Advisory opinion regarding whether Nelwyn Hebert, a member of the Iberia Parish Tourist Commission, may continue his service on the Commission if the Commission ceases producing promotional and advertising materials on behalf of Allons Mes Amis, a company owned by Nelwyn Hebert. |

Nelwyn Hebert is a member of the Iberia Parish Tourist Commission. Mr. Hebert also owns Allons Mes Amis, a company that provides travel excursions. In the past, the Iberia Parish Tourist Commission has produced promotional materials and advertising materials for Mr. Hebert's company.
In BD No. 2009-465, the Board advised that this situation posed a conflict of interest under Section 1113B and Mr. Hebert needed to either resign or the Commission needed to cease producing promotional materials and advertising materials for the Company.

Section 1113B of the Code prohibits an appointed member of a board or commission, his immediate family member, or a legal entity in which they have a substantial economic interest, from entering into or being in any way interested in a transaction that is under the supervision or jurisdiction of the board or commission.
