RE:
Request for an advisory opinion by Graham Kennedy, a member of the Tangipahoa Parish Planning Commission (TPPC), as to whether his company, Franklin Pavement Management, LLC, can contract with Tangipahoa Parish if the project falls outside the supervision and jurisdiction of the TPPC. Tangipahoa Parish has a population of 121,097.
Facts:
Graham Kennedy is an appointed member of the Tangipahoa Parish Planning Commission (TPPC). His duties involve reviewing applications for the subdivision of land submitted by land owners and developers. Additionally, the TPPC reviews commercial properties to confirm that they meet the newly created commercial property ordinances as part of the permitting process. Mr. Kennedy owns Franklin Pavement Management, LLC which provides expertise in all facets of pavement repair and maintenance. Mr. Kennedy would like to know whether it would be a violation of Louisiana ethics law for his company to contract with Tangipahoa Parish if the project fell outside the supervision and jurisdiction of the TPPC.
Law:
La. R.S. 42:1113B prohibits the appointed member of any board or commission, member of his immediate family, or legal entity in which he has a substantial economic interest from bidding on or entering into or being in any way interested in any contract, subcontract, or other transaction which is under the supervision or jurisdiction of the agency of such appointed member.

Recommendations:
Adopt the proposed advisory opinion.
