RE:
Request for an advisory opinion from Jonathan Vavasseur relative to post employment restrictions following the termination of his employment with the Louisiana Department of Transportation and Development.
Facts:
From August 2015 until July 26, 2018 Jonathan Vavasseur was employed by the Louisiana Department of Transportation and Development (DOTD) as an Environmental Impact Specialist. As an Environmental Impact Specialist, Vavasseur represented the agency at meetings, provided technical testimony and served as an expert witness at hearings, provided technical advice to task force and committee members when setting policies affecting the construction and maintenance of transportation infrastructure and environmental compliance, conducted research and prepared reports on current and future projects, provided technical environmental assistance to HQ and field personnel, developed research programs, wrote proposals, disseminated research findings through publications and research papers, developed department-wide implementation programs based on research findings, made technical and procedural decisions related to program area, and developed and directed the implementation of quality control and quality assurance procedures.

Mr. Vavasseur left DOTD and accepted a position at AECOM as a Project Biologist. This position will conduct wetland and stream delineations, prepare documents for wetlands permitting, conduct field studies, prepare natural resources technical reports, assist with preparation of NEPA, EIS, and BA documents, coordinate with local, state and federal resource agencies with regard to wetlands, natural resources, NEPA, EIS and related studies and/or permitting and work in support of regional program areas related to natural resources, coastal restoration, and coastal zone management.

Law:
La. R.S. 42:1121B prohibits any former public employee, for a period of two years following the termination of his public employment, from assisting another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed, or for a period of two years following termination of his public employment, render any service which such former public employee had rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of the agency with which he was formerly employed.
Recommendations:
Adopt the proposed advisory opinion.
