Request for an advisory opinion from Larry Broussard, former Civil Engineer Supervisor for Lafayette Consolidated Government (pop. 120,623), relative to post employment prohibitions.
Facts:
Larry Broussard retired from Lafayette Consolidated Government (LCG) as the Public Works Civil Engineer Supervisor on February 22, 2018. Mr. Broussard's position required that he perform reviews and approve private residential/commercial subdivision developments. In addition, Mr. Broussard served in the capacity of project management of LCG Department of Public Works roadway, drainage and facility infrastructure projects. Mr. Broussard reported directly to the Director of Public Works. Mr. Broussard has become employed as an Engineer III with C.H. Fenstermaker & Associates, LLC (Fenstermaker) and would like to know the parameters of the prohibition of post-public employment under the Code of Governmental Ethics.
Law:
La. R.S. 42:1121A(1) prohibits a former agency head or elected official, for a period of two years following the termination of his public service as the head of such agency, from assisting another person, for compensation, in a transaction, or in an appearance in connection with a transaction, involving that agency or render any service on a contractual basis to or for such agency.

La. R.S. 42:1121B(1) prohibits a public employee, for a period of two years following the termination of his public employment, from assisting another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed, or for a period of two years following termination of his public employment, rendering, any service which such former public employee had rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to, for or on behalf of the agency with which he was formerly employed.

Recommendations:
Adopt the proposed advisory opinion.
