RE:
Request for an advisory opinion from American Planning Association relative to whether their members, some of which are state or local government employees, can lobby state legislators.
Facts:
The American Planning Association (APA) is a trade group composed of members who are all planners of some type, such as urban planners, transportation planners, environmental specialists, designers, and economic development professionals. Many of the members work for local or state government. APA desires to take on some advocacy work to support legislation at the state and local levels. APA will not endorse a candidate.
Law:
La. 24:56F prohibits a state employee in his official capacity or on behalf of his employer from lobbying for or against any matter intended to have the effect of law pending before the legislature or any committee thereof.

La. R.S. 42:1115A(2) prohibits a public servant from soliciting or accepting, directly or indirectly, any thing of economic value as a gift or gratuity from any person or from any officer, director, agent, or employee of such person, if such public servant knows or reasonably should know that such person is seeking, for compensation, to influence the passage or defeat of legislation by the public servant's agency.

Recommendations:
Decline to render, but inform as to R.S. 24:56F and 42:1115A.
