RE:
Request that the Board reconsider waiving the $700 campaign finance late fee assessed against Dale N. Atkins, a candidate for Judge, Court of Appeal, 4th Circuit, 1st District, Division F, Orleans Parish, and the committee's chairperson, E. John Litchfield, and treasurer, Carey B. Daste, in the March 24, 2018 election, whose 2017 Annual campaign finance report was 7 days late.
Facts:
Carey B. Daste, Treasurer for Dale Atkins, states that due to the very short period of time between the organization of the committee and the end of the year, and because the Certificate of Registration received from the Board of Ethics covered the calendar year 2018 and did not include the time period from the date the committee was first organized on December 15, 2017 through December 31, 2017, the committee mistakenly believed that the first report which should be filed for this campaign would be the 30-P report due on February 22, 2018. He also states the he though this period should include the transactions occurring from the time the committee was organized through February 12, 2018. She states the committee immediately complied with the March 26, 2018 notices received the from Board of Ethics to avoid further action in connection with the inaccuracies listed in that notice and the mistake was unintentional.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
