RE:
Advisory opinion regarding whether the wife of Tommy Angelle, Lafayette Parish School Board member, may provide bus services to students in the parish.
Facts:
Tommy Angelle has recently been elected to the Lafayette Parish School Board. His wife has been employed by Associated Travel Group. Mrs. Angelle's work involved securing bus transportation for Lafayette Parish public school students to various functions, i.e., football games, band concerts, field trips, as well as transportation for speech debate teams, cheerleaders, and dance team for the past 10 years. Mrs. Angelle gets paid by commissions; therefore, the exception in BD 82-02D is inapplicable.



The School Board does not choose the travel agency or bus company to provide transportation. Rather, that decision is made by the various teachers, coaches, band directors, speech team sponsors, etc.

Law:
Section 1111C(2)(d) prohibits a public servant from accepting anything of economic value in consideration of services rendered from a person who has or is seeking to have a business, financial, or contractual relationship with the public servant's agency.
Recommendations:
Adopt proposed advisory opinion.
