Advisory Opinion request from Christopher B. Allen, former employee of the La. Coastal Protection and Restoration Authority ("CPRA") working for Atkins Global.
Facts:
Christopher Allen was employed at CPRA from March 2009 until October 22, 2018, as a Project Manager in CPRA's Project Management Division. He participated in multiple projects, including grants received from the National Fish and Wildlife Foundation ("NFWF") Program, which is a 501(c)(3) nonprofit organization charged with administering grants as a result of the BP and Transocean oil spill settlement. Mr. Allen's duties for the NFWF Program included: (1) working with the project team to complete the grant application, (2) amending the grant application, (2) requesting reimbursement from NFWF for CPRA expenditures, and (4) serving as liaison between CPRA and NFWF for administrative issues. He reported to a Supervisor within the Project Management Division.

Atkins Global is an international engineering and environmental consulting firm that performs coastal engineering and environment work. Through a consulting services contract with CPRA, Atkins Global was issued a project called "Mid Breton Sediment Diversion - Applicant Environmental Impact Statement Support." While funded by the grant from the NFWF, this specific project is managed by the CPRA Operations Division. The CPRA Project Management Division has no responsibility for this project and Mr. Allen did not participate in any decisions or recommendations on any aspect of this project.

Law:
La. R.S. 42:1121B provides no former public employee shall, for a period of two years following the termination of his public employment, assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed, or for a period of two years following the termination of his public employment, render, any service which such former public employee had rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of the agency with which he was formerly employed.
Recommendations:
Adopt the proposed advisory opinion.
