Advisory opinion regarding whether a former employee of the Department of Health and Hospitals may accept a position with Thomson Reuters.
Facts:
Melissa Jacobs has been employed with the Department of Health and Hospitals as a Program Manager of the Physician Directed Services Unit of the Bureau of Health Services Financing Office of Management since May of 2010. As a Program Manager, Ms. Jacobs manages the medical and non-medical staff of the Physician Directed Services Unit. The submitted organizational chart shows that she is under the supervision of the Section Chief of the Program Operations Section in the Bureau of Health Services Financing. She assists the Section Chief in the managing, directing, coordinating, developing, and administering of the operational activities for several statewide components of the Medical Assistance Program. Ms. Jacobs will terminate her employment with DHH. As an employee of Thomson Reuters, Ms. Jacobs will be working with the J-SURS data mining system which is utilized by Medicaid Integrity agencies in 14 states throughout the country. At this time, Thomson Reuters does not have any contracts with DHH.

Law:
Section 1121A(1) of the Code prohibits a former agency head, for a period of two years following the termination of his public service, from assisting another person for compensation in a transaction, or in an appearance in connection with a transaction, involving his former agency or render any service on a contractual basis to or for such agency. Section 1102 of the Code defines an agency head as the chief administrative officer of an agency.



Recommendations:
Adopt the proposed advisory opinion.
