Facts:
Advisory opinion regarding whether the Code of Governmental Ethics would prohibit Pascal Architects from bidding on or entering into a contract with Louisiana State Board of Medical Examiners while Dr. Vincent J. Culotta, Jr. serves as the Executive Director. On August 23, 2018, Dr. Vincent J. Culotta, Jr. was informed that the Louisiana Architectural Selection Board planned to meet to review potential applicants for a construction project sought by the Louisiana State Board of Medical Examiners. He stated that upon his review of the list of prospective bidders, he noticed Pascal Architects, in which his brother, P. Mark Culotta, owns over 25%. Dr. Culotta informed the Architectural Selection Board immediately and requested that the request for bids be postponed until he had time to seek a legal opinion from the Ethics Board as to any potential conflict of interest.
Law:
La. R.S. 42:1113A prohibits a public servant, or a member of such public servant's immediate family, or a legal entity in which he has controlling interest, from bidding on or entering into any contract, subcontract or other transaction that is under the supervision or jurisdiction of the public servant's agency.
Recommendations:
Adopt draft advisory opinion.
