Advisory opinion request by Kevin Cyrus, a West Baton Rouge Sheriff's Deputy, regarding whether he can operate a driving school while he serves as a West Baton Rouge Sheriff Deputy.
Facts:
Kevin Cyrus wishes to operate Baton Rouge Driving Academy in Baton Rouge. As the sole owner of the driving school, he would offer a thirty-eight hour class, a fourteen hour class, a road skills test for any person applying for a first time license, and a defensive driving class.

Mr. Cyrus serves as a Captain in the Criminal Investigations Division which involves detective work. He occasionally works Louisiana Highway Safety Commission grants for impaired drivers and occupant restraints. He also assists in traffic stops in extenuating circumstances when assistance is requested for officer safety; however, traffic stops and citations are not part of his daily responsibilities. Mr. Cyrus stated that the 18th J.D.C., which encompasses his jurisdiction as deputy, does require driver improvement programs as a condition of sentencing.

Law:
La. R.S. 42:1111C(1)(a) provides that no public servant shall receive anything of economic value for any service, the subject matter of which is devoted substantially to the responsibilities, programs, or operations of the agency of the public servant and in which the public servant has participated.
Recommendations:
Adopt proposed opinion.
