RE:
Advisory opinion request by Tammy Anderson, Transportation Manager, regarding whether she and four transportation permit supervisors within the Department of Transportation and Development Truck Permit Office may sponsor a gift incentive to be provided to transportation permits specialists based on performance, dependability, and accuracy.
Facts:
Ms. Anderson and the four transportation permit supervisors would like to donate $10 each payday to go towards two or three monthly gift cards, totaling $25 each, for the permit specialists. The participation in the incentives gifts is strictly voluntary in nature by the supervisors and manager. If any supervisor or manager chooses not to contribute, it would not disqualify their subordinates from receiving or qualifying for the gifts. The supervisors and managers would not be eligible to receive the gift cards.

There will be four separate ways a person could receive a gift card with a rotation of three categories per month. The employee of the month gift card would be voted on by all employees in the Truck Permit Office at the end of each month. The employee with the most votes would receive a gift card. One gift card would be decided by using the average number of permits issued in the month. All employees who issued the average number or above, their names will be placed in a drawing and a winner will be chosen. Another gift card will be decided on dependability. All employees who did not miss any time and was on time from lunch and breaks for the month will be placed in a drawing. The last gift card will be decided by number of errors made in a month. All employees who had a below average of mistakes for the month will be placed in a drawing. The office would have some type of office appreciation for everyone with any of the remaining donated funds.
Law:
La. R.S. 42:1111A(1)(a) provides that no public servant shall receive anything of economic value, other than compensation and benefits from the governmental entity to which he is duly entitled to receive, for the performance of the duties and responsibilities of his office or position.
Recommendations:
Adopt the proposed opinion.
