Advisory opinion regarding whether the son of Richard Paul Lee, Assistant Chief of the Hammond Fire Department, may be employed by the Fire Department. |

Richard Paul Lee is employed by the City of Hammond within the Hammond Fire Department where he serves as the Assistant Chief. Mr. Lee does not have the ability to hire or fire employees as this duty is reserved to the Fire Chief. Mr. Lee's son, Jacob Paul Lee, has applied for a position with the Fire Department.

Section 1119A states that no member of the immediate family of an agency head shall be employed in his agency. Section 1102(3) defines an "agency head" as the chief executive or administrative officer of an agency.
Section 1112B(1) of the Code prohibits a public servant, except as provided in Section 1120, from participating in a transaction involving the governmental entity in which, to his actual knowledge, a member of his immediate family has a substantial economic interest.
