RE:
Request for an advisory opinion from Mary C. Juneau, town clerk in Boyce (pop.1004), Rapides Parish, relative to whether she could be reappointed town clerk if her husband won election to the town council.
Facts:
Mary C. Juneau has served as the town clerk in Boyce, Rapides Parish, since February 28, 2011 being reappointed after each election. Ms. Juneau's husband, Thomas Juneau has qualified for election to the town council of Boyce scheduled for November 6, 2018. Ms. Juneau would like to know whether she could be reappointed as town clerk in the event her husband would be elected to the town council?
Law:
La. R.S. 42:1113A(1)(a) prohibits a public servant, or member of his immediate family, or legal entity in which he has a controlling interest from bidding on or entering into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of his agency.
Recommendations:
Adopt the proposed advisory opinion.
