RE:
Advisory Opinion request from Ronald Scott, an employee of the Town of Gramercy, as to whether he may provide backflow preventer services to business in the town.
Facts:
Ronald Scott is employed by the Town of Gramercy as the Maintenance Supervisor. His duties include general maintenance and repairs, including water cutoffs and restoration, as well as repairs to the city-owned water lines. Mr. Scott does not perform any maintenance or repairs on private property.

The Town requires certain businesses to install a backflow preventer to avoid contamination of the water system; however, the Town does not conduct the installation, testing, or servicing of the backflow preventers. Neither Mr. Scott, nor any other employee in the Maintenance Department, has any participation with this determination.

Mr. Scott recently completed the certification to become a Certified Backflow Preventer Tester. He would like to start his own business conducting the tests outside of his normal working hours.

Law:
La. R.S. 42:1111C(2)(d) prohibits a public servant from receiving anything of economic value for services provided to a person who conducts operations or activities which are regulated by the public employee's agency.
Recommendations:
Adopt the proposed advisory opinion.
