RE:
Request for approval of a disqualification plan submitted by M. Bofill Duhe, District Attorney for the 16th Judicial District, relative to two employees who are mother and daughter.
Facts:
Lisa Miller has been employed in the District Attorney's Office for the 16th Judicial District (Parishes of Iberia, St. Martin, St. Mary) for 19 years. Raven Miller Boudreaux, the daughter of Lisa Miller, has been employed in the same agency for over 5 years as a Victim's Assistance Coordinator. Lisa Miller is due to be promoted to the position of Office Manager, which would have supervisory duties over Raven Miller Boudreaux. The District Attorney proposes to limit any supervision by Lisa Miller over Raven Miller Boudreaux by having the managing Assistant District Attorney in St. Mary Parish or the First Assistant District Attorney for the 16th Judicial District supervise Raven Miller Boudreaux on matters concerning pay, promotion, termination, and performance evaluations.
Law:
La. R.S. 42:1112B(1) prohibits a public servant from participating in a transaction involving the governmental entity in which, to his actual knowledge, any member of his immediate family would have a substantial economic interest.
Recommendations:
Accept the proposed disqualification plan.
