Request for an advisory opinion by Michael Giroir, a drivers education teacher at Morgan City High School in St. Mary Parish (pop.54,650), regarding whether he could provide private testing to drivers education students.
Facts:
Michael Giroir is employed by the St. Mary Parish School Board. Mr. Giroir is a driver's education instructor at Morgan City High School. The driver's education course covers driving safety, defensive driving, rules of the road, and Louisiana driving laws. The driver's education course offered in St. Mary Parish does not include a skills test or a knowledge test for students once they have completed their course work.

Giroir would like to start a private testing entity to provide St. Mary Parish students with skills and knowledge testing for driver's education students. Mr. Giroir would receive compensation from the students for providing the testing.

Law:
La. R.S. 42:1111A(1)(a) prohibits a public servant from receiving anything of economic value, other than compensation and benefits from the governmental entity to which he is duly entitled, for the performance of the duties and responsibilities of his office or position.

La. R.S. 42:1111C(1)(a) prohibits a public servant from receiving any thing of economic value for any service, the subject matter of which is devoted substantially to the responsibilities, programs, or operations of the agency of the public servant and in which the public servant has participated.

Recommendations:
Adopt the proposed advisory opinion.
