Advisory opinion request and approval of a disqualification plan by Keith Stutes, District Attorney for the 15th Judicial District, regarding the hiring of Christian Landry as an Assistant District Attorney while his father, Daniel Landry, III, serves as First Assistant District Attorney.
Facts:
Daniel Landry's duties as First Assistant District Attorney do not involve the hiring, firing or administering of the employees of the Office of the District Attorney for the 15th Judicial District. Mr. Stutes has decided to offer employment to Christian Landry. He stated that Daniel Landry has not participated in the hiring process nor will he take part in or share responsibility for, either through approval, disapproval, decision, recommendation, rendering of advice, investigation of failure to act or perform, any duty which may be imposed on Christian Landry as an Assistant District Attorney of his office. Additionally, Mr. Stutes will exercise ultimate discretion over all matters concerning Christian Landry's employment with his office.
Law:
La. R.S. 42:1119A provides that no member of the immediate family of an agency head shall be employed in his agency.
Recommendations:
Adopt the proposed opinion and approve the proposed disqualification plan.
