Waiver request submitted by Jaclyn Suzanne Hotard, St. John the Baptist Council, regarding a $800 late fee assessed for filing her amended 2016 Tier 2 annual pfd 8 days late.
Facts:
Ms. Hotard states that she did not sign for the NOD and as soon as she learned of her error in her filing she called Robin. Ms. Hotard states that she was told by Robin that the NOD would be re-issued. However, the comments do not reflect that, but instead provide that Ms. Hotard advised Robin to reissue the Late Fee Order to a new address so she could request a waiver based on her not signing for the NOD since her friend was residing at her home and signed for the NOD but failed to give it to her in a timely fashion. Ms. Hotard claims that she spoke with Robin again and that Robin indicated the matter had been closed. Again, the comments do not reflect this conversation. Ms. Hotard request that the Board take all of these facts into consideration for her waiver request.

Law:
La. R.S. 42:1124.2 requires each person holding a public office who represents a voting district having a population of 5,000 or more persons to file an annual personal financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Rescind the late fee.
