Advisory opinion request as to whether Aimee Bordelon Dupuy may vote on certain issues as a newly-elected member of the Avoyelles Parish School Board.
Facts:
Aimee Bordelon Dupuy inquired as to whether she may vote on certain issues as a newly-elected member of the Avoyelles Parish School Board. Ms. Dupuy currently serves as an uncompensated board member of Red River Charter Academy, a non-profit corporation which was granted a Type 2 charter from BESE on December 12, 2018. There may be negotiations in the future between the Avoyelles Parish School Board and Red River Charter Academy regarding the type of charter, rental of buildings, and transportation. Ms. Dupuy has requested an opinion from the Attorney General's Office concerning the situation to determine if holding both positions would present an issue associated with the Louisiana Dual Office Holding laws.
Law:
La. R.S. 42:1112B(3) prohibits a public servant from participating in a governmental transaction in which any person of which he is an officer, director, trustee, partner, or employee has a substantial economic interest.

La. R.S. 42:1123(1) allows for participation in the affairs of charitable, religious, non-profit educational, public service, or civic organizations when no compensation is received.

Recommendations:
Adopt the proposed advisory opinion.
