Request for an advisory opinion from the legal counsel for St. Mary Parish Government relative to the acceptance of donated services to the Atchafalaya Golf Course Commission by a person who is the son of the Chairman of the Atchafalaya Golf Course Commission.
Facts:
The Atchafalaya Golf Course Commission (AGCC) is a political subdivision of St. Mary Parish Government, charged with the operation of Atchafalaya At Idlewild, a parish owned and operated golf course. The AGCC has been offered the donated services of a greens superintendent from Texas who is the son of Rudy Sparks, the Chairman of the AGCC. The son of the chairman will have no title or position and will merely visit the course occasionally to offer general advice on greens management.
Law:
La. R.S. 42:1113A prohibits a public servant, or member of his immediate family, or legal entity in which he has a controlling interest from bidding on or entering into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of his agency.

La. R.S. 42:1123(30) provides that a public servant, a legal entity in which he has a controlling interest, or a member of his immediate family is not precluded from donating services, movable property, or funds to his agency. Nothing herein shall be construed to allow a public servant to make an appointment of a person which is otherwise prohibited by this Chapter.


Recommendations:
Adopt the proposed advisory opinion.
