Advisory opinion regarding whether the members of the Louisiana Sexual Assault Oversight Commission are required to file annual personal financial disclosure statements.
Facts:
The Louisiana Sexual Assault Oversight Commission was created by statute, R.S. 15:555, 15:556 and R.S. 36:706(D). The Louisiana Sexual Assault Oversight Commission is housed with the Department of Justice in the Attorney's General Office. The Louisiana Sexual Assault Oversight Commission does not expend or collect any funds and the members or their designee serve without compensation, travel expenses, or per diem. And if other expenses are incurred, such may only be paid by the member's employer or appointing authority. The Louisiana Sexual Assault Oversight Commission does not have any employees. The Attorney General provides the Louisiana Sexual Assault Oversight Commission with all staff and administrative services necessary.
Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.
Recommendations:
Adopt proposed advisory opinion.
