| Advisory Opinion request from Jude Reese, Mayor of Gueydan (Pop. 1,398) in Vermilion Parish, as to whether the Town can enter into transactions with volunteer fire fighters and reserve police officers. |

Jude Reese is the Mayor of the Town of Gueydan. He stated that the Town is governed by the Lawrason Act. He asks whether a person who is a volunteer firefighter and/or a reserve police officer may enter into transactions with the Town. He stated that neither position receives compensation for their services.

La. R.S. 42:1113A(1)(a) provides that no public servant, their immediate family member, or a legal entity in which he has a controlling interest shall bid on or enter into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the public servant's agency.
La. R.S. 42:1123(35) provides the following exception to this prohibition:
Any volunteer fireman or uncompensated law enforcement officer or legal entity in which he has an interest from bidding on or entering into a contract, subcontract, or other transaction under the supervision and jurisdiction of his agency; provided that the volunteer fireman or uncompensated law enforcement officer shall receive no compensation or thing of economic value for his service as a volunteer fireman or uncompensated law enforcement officer, that the volunteer fireman or uncompensated law enforcement officer shall not be an agency head, and that the volunteer fireman or uncompensated law enforcement officer shall not participate on behalf of his agency in any capacity regarding such contract, subcontract, or other transaction.
