Advisory opinion request as to whether Bernard Brown III may work as an independent contractor with the Public Defender's Office while maintaining his full-time employment with the Louisiana Department of Health.
Facts:
Bernard Brown III would like to work as an independent contractor with the Public Defender's Office while maintaining his full-time employment with the Louisiana Department of Health (LDH). Mr. Brown is employed at LDH as Executive Management Officer, and his primary duty is to assist and advise the Assistant Secretary of the Office of Citizens with Developmental Disabilities. Some of his tasks include strategic planning, drafting talking points, and managing special projects. Mr. Brown has never worked at LDH as a staff attorney, and his job duties do not include providing legal services to LDH.
Law:
La. R.S. 42:1113 prohibits public servants, their immediate family members, or legal entities in which they have a controlling interest, from entering into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant.
Recommendations:
Adopt the proposed advisory opinion.
