Request for an advisory opinion regarding post-employment restrictions that would apply to Kim Bailey Barnette after her retirement from the Department of Public Safety & Corrections.
Facts:
Kim Bailey Barnette retired on December 1, 2017, as the State Director of Education for the Department of Public Safety & Corrections (DPSC). Her job duties at DPSC entailed oversight of education programs for offenders under the operation of the DPSC and directed Title I and Adult Education Grants for offenders.
Ms. Barnette is currently contracting with Ashland University of Ohio (AU) to connect AU's federally funded correctional education online programs to state and federal prisons, local jails, and detention centers across the nation. Her job entails identifying correctional facilities in need of college programs and connecting the AU staff with the correctional facility's administration. She does not oversee the AU programs at the facilities, but merely leads in the identification of program placement. Ms. Barnette would like to communicate with Louisiana jails and detention centers operated by local sheriffs' offices which house local and state offenders about federally funded programs offered by AU.

Law:
La. R.S. 42:1121A prohibits a former agency head, for a period of two years following the termination of his public service as the head of such agency, from assisting another person, for compensation, in a transaction, or in an appearance in connection with a transaction, involving that agency or rendering any service on a contractual basis to or for such agency.
Recommendations:
Adopt the proposed advisory opinion.
