Advisory opinion request regarding whether the Code of Governmental Ethics would prohibit Jodi Stansbury, the spouse of Youngsville City Councilman Kenneth Stansbury, from being appointed to the Youngsville Beautification Committee (Committee) by the Youngsville City Council.
Facts:
Mr. Knox stated that the Committee was created by the Youngsville City Council on September 13, 2018. The Committee is to be composed of nine members. Applications for appointment to the Committee were prepared and any interested citizen was encouraged to apply. An application for appointment to the Committee was received from Jodi Stansbury, the wife of City Councilman Kenneth Stansbury. The Council passed a resolution to submit this request for an advisory opinion to the Board before making the final appointment of the members of the Committee.
Law:
La. R.S. 42:1113A(1) prohibits a member of a public servant's immediate family from bidding on or entering into any contract, subcontract or other transaction that is under the supervision of his agency.

La. R.S. 42:1123 (30) provides that a public servant's immediate family member is not precluded from donating services, movable property, or funds to his agency. However, nothing herein shall be construed to allow a public servant to make an appointment of a person which is otherwise prohibited by this Chapter.

Recommendations:
Adopt draft advisory opinion.
