Advisory opinion request regarding whether the Code of Governmental Ethics would prohibit the Jackson Parish Police Jury from appointing Jay Mallard to the Watershed District Board.
Facts:
The Jackson Parish Police Jury has a duty to appoint citizens to the Watershed District Board. The Watershed District Board members service is voluntary and they do not receive any compensation for their service. The Watershed District does not own any vehicles nor do they have any intention of purchasing any vehicles in the future. Mr. Mallard is the owner of Jay Mallard Ford Lincoln in Jonesboro, Louisiana. The Police Jury has no authority over the Watershed District other than appointing members. Mr. Mallard has on occasion submitted a bid on contracts to sell the Police Jury vehicles. Mr. Mallard asked if he accepts the position on the Watershed Board will Jay Mallard Ford Lincoln still be able to bid on Parish contracts if the opportunity presents itself. Mr. Mallard provided that he understands that he cannot submit any bids related to Watershed projects.
Law:
La. R.S. 42:1113A(1) prohibits a public servant or a legal entity in which he has a controlling interest from bidding on or entering into any contract, subcontract or other transaction that is under the supervision of his agency.
Recommendations:
Adopt draft advisory opinion.
