Advisory opinion request by Luanna Cambas, P.E., regarding whether she or Pave Way, Inc. may perform work for the Department of Transportation and Development (DOTD) Materials & Testing Lab in Baton Rouge, the Louisiana Transportation Research Center (LTRC), the DOTD Contracts & Specifications Section, or the DOTD Headquarters Construction Section after her retirement from the DOTD District 2 Laboratory in Bridge City, Louisiana.
Facts:
Ms. Cambas wholly owns Pave Way, Inc., which is a licensed engineering firm that supplies construction materials, such as electrical and plumbing equipment.
Ms. Cambas currently serves as the District Laboratory Engineer for District 2 handling quality assurance for the District's road and bridge construction projects. The lab samples and tests asphalt, soil, concrete, aggregates and other construction materials, develops project sampling plans, and reviews final Summary of Test Results. She also reviews concrete and asphalt mix designs and certifies plans. She reviews District Design plans for constructability, and serves as the District Debris Manager.
As the District Laboratory Engineer, Ms. Cambas manages and supervises one engineer and eleven technicians. Either Ms. Cambas or employees within her agency certify Concrete and Asphalt Production Plans and Sampling Plans for each construction project in the District, and review and make recommendations on District plans. She also completes and signs Constructability Review Forms. Ms. Cambas does not currently create, update, or revise manuals, specifications, construction training documents, presentations or other similar documents at the District 2 Laboratory.
Ms. Cambas serves on a committee to review research projects for LTRC. LTRC chooses participants with specialized technical knowledge from various sections of DOTD and other public and private entities. She participated in a series of meetings to review the Quality Assurance Manual for Asphalt. She has previously responded to calls and invitations to meeting from the Materials & Testing Lab, LTRC, Contracts & Specifications Section, and Headquarters Construction Section as an employee of District 2.


Ms. Cambas would like to review District Design plans. These plans include design roadway improvement projects within the seven parishes of the District 2 Design Office. These projects usually have items such as asphalt overlays, turn lanes, widening, drainage work, striping, signage, traffic signals, embankment and associated work items. She would like to create, update, or revise manuals, specifications, construction training documents, presentations, or similar if offered.
Law:
La. R.S. 42:1121A provides that no former agency head or elected official shall, for a period of two years following the termination of his public service as the head of such agency or as an elected public official serving in such agency, assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction, involving that agency or render any service on a contractual basis to or for such agency. Additionally, no former member of a board or commission shall, for a period of two years following the termination of his public service on such board or commission, contract with, be employed in any capacity by, or be appointed to any position by that board or commission.

La. R.S. 42:1121B provides that no former public employee shall, for a period of two years following the termination of his public employment, assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed, or for a period of two years following termination of his public employment, render, any service which such former public employee had rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of the agency with which he was formerly employed.
