RE:
Request for an advisory opinion from Carla Chiasson, the Grants Officer with St. Charles Parish Government, as to whether she can provide grant counseling to governmental agencies other than St. Charles Parish Government.
Facts:
Carla Chiasson is employed by the St. Charles Parish Government as a Grants Officer. Ms. Chiasson's duties are to lead the Grants Office in applying for and administering federal, state and corporate foundation grant funds on behalf of St. Charles Parish strictly for parish government projects and programs. The Grants Office does not assist individuals, non-profit organizations, the St. Charles Parish Sheriff's Office, or the St. Charles Parish School Board.

Ms. Chiasson recently formed 2C's Consulting, LLC for the purpose of providing grant consulting to state and local government agencies, quasi-government agencies, non-profit organizations, and other eligible entities within St. Charles Parish, the State of Louisiana, and nationwide.

Law:
La. R.S. 42:1111C(1)(a) prohibits a public servant from receiving any thing of economic value for any service, the subject matter of which is devoted substantially to the responsibilities, programs, or operations of the agency of the public servant and in which the public servant has participated.

La. R.S. 42:1113A(1)(a) prohibits a public servant, or member of his immediate family, or legal entity in which he has a controlling interest from bidding on or entering into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of his agency.

La. R.S. 42:1111C(2)(d) prohibits a public servant and a legal entity in which the public servant exercises control or owns an interest greater than 25%, from receiving any thing of economic value for services rendered to or for any person during his public service unless such services are neither performed for nor compensated by any person who (1) has or is seeking to have a contractual, business, or financial relationship with the public servant's agency; (2) conducts operations or activities that are regulated by the public employee's agency; or, (3) has a substantial economic interest which may be substantially affected by the performance or nonperformance of the public employee's official duty.

Recommendations:
Adopt the proposed advisory opinion.
