| Advisory opinion request by Don Marshall, Executive Director for the New Orleans Jazz & Heritage Festival and Foundation, Inc. (Foundation), regarding whether Jay Banks may receive complimentary Jazz Festival tickets while serving on the New Orleans City Council and as a member of the Foundation's Board of Directors. |

Jay Banks has been a member of the Foundation Board for several years. He was elected to the New Orleans City Council in 2018.
The Foundation has contracts, both written and oral, with City of New Orleans Departments. The Foundation Board members are regularly given complimentary Jazz Festival tickets and do not receive any additional compensation for their service on the its board of directors. It is generally understood that these tickets are given to Foundation board members in consideration of their uncompensated work for the Foundation. Other than the Jazz Festival, all musical concerts and other events sponsored by the Foundation are free to the general public.

La. R.S. 42:1115A(1) provides that no public servant shall solicit or accept, directly or indirectly, any thing of economic value as a gift or gratuity from any person or from any officer, director, agency, or employee of such person, if such public servant knows or reasonably should know that such person has or is seeking to obtain contractual or other business or financial relationships with the public servant's agency.
