Advisory opinion request by Robert Dale regarding whether he could work for a consulting engineer, Atrovia, LLC, who is a subcontractor providing services to the Jefferson Parish Sewerage Department within two years of his departure from the Jefferson Parish Drainage/Pumping Stations Division.
Facts:
Digital Engineering is the primary contractor who also has other contracts with multiple Jefferson Parish Departments including the Drainage/Pumping Stations Division. Mr. Dale has not been employed by the Sewerage Department since 2003.

Robert Dale served as the Assistant Director of the Jefferson Parish Department of Drainage/Pumping Stations from 2010 to 2017. In this position, he supervised nine employees including field supervisors, engineers, and operators and oversaw the operations, maintenance, and repairs of all Jefferson Parish Drainage pumping stations. He worked with consultant engineers to develop detailed scope of various drainage improvement projects throughout Jefferson Parish; reviewed plans and specifications related to new construction, repairs, maintenance, and upgrades of drainage pump stations and drainage collection network; performed site inspection of construction to requirements were met; assisted in evaluating bids and prepared recommendations on new equipment purchases; managed the computer automated pump station work order maintenance system; and, assisted in the preparation and update of the Drainage Emergency Plan used in preparation for hurricane season. Additionally, Mr. Dale did not participate in the Sewerage Department capital projects while employed by the Drainage/Pumping Stations Division.
Law:
La. R.S. 42:1121A provides that no former agency head or elected official shall, for a period of two years following the termination of his public service as the head of such agency or as an elected public official serving in such agency, assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction, involving that agency or render any service on a contractual basis to or for such agency.

La. R.S. 42:1121B provides that no former public employee shall, for a period of two years following the termination of his public employment, assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed, or for a period of two years following termination of his public employment, render, any service which such former public employee had rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of the agency with which he was formerly employed.
