RE:
Request that the Board waive $1,000, $400 and $480 campaign finance late fees assessed against Joyce Burges, a candidate for Member of School Board, District 3, City of Baker, East Baton Rouge Parish, in the November 6, 2018 election, whose 30-P, 10-P and 10-G campaign finance disclosure reports were filed 31, 11 and 12 days late, respectively.
Facts:
Joyce Burges states that during her campaign, she had no paid, volunteer or dedicated staff. She states all campaigning and reports were done by herself and her spouse. In reviewing the timeline of the report submittal, she states it is clear that the 30-P and 10-P reports were done and faxed to our office 3 days after the completion of the November 6th primary. She states that this is not to provide an excuse for late submittals, but a reason why she is requesting a waiver of fees assessed. She believes that her past record of filing reports and the intent on her recent filing reflect her integrity. Therefore, she respectfully requests a waiver.

In reference to the late filing of the 10-G report, Ms. Burges states that after winning the election in the primary and filing forms 30-P and 10-P for the campaign, she thought that her reporting responsibilities were complete until she received correspondence from the Louisiana Board of Ethics stating that there was a report due.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed.

18:1495.4D(1) If the final report of a candidate for an election, as required by Paragraph (5), (6), or (7)of Subsection B of this Section, shows a deficit or a surplus, the candidate and his treasurer, if any, shall file supplemental reports with the supervisory committee of all information required in R.S. 18:1495.5. Such reports shall be filed annually no later than February fifteenth and shall be complete through the preceding December thirty-first. Such a supplemental report shall be filed each year until a report has been filed which shows no deficit and until any surplus campaign funds have been disposed of in accordance with R.S. 18:1505.2(I). The report on surplus funds shall disclose the disbursement of such funds in the same manner as expenditures are reported.

Recommendations:
Decline to waive for the 30-P.

Suspend all but $100 for the 10-P and 10-G reports based on future compliance. The late fees must be paid within 30 days or the suspended portion becomes due and owing.
