Waiver request submitted by Mr. Scott Alden Couvillion, a former member of the Audubon Area Security District, regarding a $100 late fee assessed for filing his 2017 Tier 2.1 annual pfd 2 days late.
Facts:
Mr. Couvillion received his NOD on 1/10/2019. He states that he made numerous attempts to contact our office and left voice mail messages but did not receive a return call until 2 days after the due date to files his PFD. (Note: calls were being forwarded to a voice mail for a staff member who was ill and not in the office. Mr. Couvillion called on 1/24/19 and requested a supervisor. His call was forwarded to K. Winfrey and his issues were addressed.) He also indicates that he uploaded his 2016 and 2017 documents and received an email confirmation on the 2016 upload. He assumed his documents were received and didn't realize the problem until he received the NOD. He asks the board to consider his efforts to comply by uploading his documents and by making numerous phone calls to try to resolve the problem.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Suspend all based on future compliance with the reporting requirements under the Code of Ethics.
