Advisory opinion request regarding whether the Code of Governmental Ethics prohibits Daniel J. Adams, a part-time employee of Louisiana Department of Hospitals Office of Behavioral Health (LDH/OBH), from providing services to Louisiana Bureau of Emergency Management Services.
Facts:
Mr. Adams stated that he currently serves as an Assistant Program Manager for LDH/OBH. His duties include first responder outreach after disasters. He also provides services to aid in emergency preparedness. Mr. Adams is a retired Assistant Fire Chief from Baton Rouge. He has an opportunity to teach Critical Incident Stress Management for the Louisiana Bureau of Emergency Management Services. He stated that he does not teach Critical Incident Stress Management for LDH/OBH. Further, he provided that he currently teaches SafeTALK T4T training, regarding suicide alertness and identification, through the living network.net to other qualified trainers and LDH/OBH does not currently offer SafeTALK T4T training. However, he wants to know if LDH/OBH was to get a grant to provide SafeTALK T4T and increase his job duties to include training would he be able to teach SafeTALK T4T for LDH/OBH.
Law:
La. R.S. 42:1102(16) "person" means an individual or legal entity other than a governmental entity, or an agency thereof.

La. R.S. 42:1111C(1)(a) prohibits a public servant from receiving any thing of economic value for any service, the subject matter of which is devoted substantially to the responsibilities, programs, or operations of the agency of the public servant and in which the public servant has participated.

La. R.S. 42:1111C(2)(d) provides that no public servant and no legal entity in which the public servant exercises control or owns an interest in excess of twenty-five percent, shall receive any thing of economic value for or in consideration of services rendered, or to be rendered, to or for any person during his public service unless such services are: (d) Neither performed for nor compensated by any person or from any officer, director, agent, or employee of such person, if such public servant knows or reasonably should know that such person has or is seeking to obtain contractual or other business or financial relationships with the public servant's agency; conducts operations or activities which are regulated by the public employee's agency; or has substantial economic interests which may be substantially affected by the performance or nonperformance of the public employee's official duty.

Recommendations:
Adopt draft advisory opinion.
