Advisory opinion request regarding whether the Code of Governmental Ethics would prohibit Ray Williams, the elected Police Chief for the Village of Pleasant Hill, from being employed as a School Resource Officer in Sabine Parish schools.
Facts:
Ray Williams is the elected Police Chief for the Village of Pleasant Hill, which is located in Sabine Parish. Pleasant Hill High School is located within the Village of Pleasant Hill. The Sabine Parish School Board has been in negotiations with the Sheriff of Sabine Parish about the possibility of expanding the SRO program in Sabine Parish schools. Members of the Sabine Parish School Board would like to know whether the Ethics Code would permit the Sheriff to employ Mr. Williams as a SRO and assign him to Pleasant Hill High School during regular school hours while he continues to serve as Police Chief for the Village of Pleasant Hill. As Police Chief, Mr. Williams is on call twenty-four hours per day. If he was required to leave his post as a SRO during the school day to handle a police matter for the Village of Pleasant Hill, it is understood that he would not be compensated by the Sheriff for the time away from school.
Law:
La. R.S. 42:1111A(1)(a) provides that no public servant shall receive anything of economic value, other than compensation and benefits from the governmental entity to which he is duly entitled, for the performance of the duties and responsibilities of his office or position.
Recommendations:
Adopt the proposed advisory opinion.
