RE:
Request that the Board waive $1,000, $716 and $1,000 campaign finance late fees assessed against Tammy Lamy, a candidate for Member of School Board, District 11, St. Tammany Parish, in in the November 6, 2018 elections, whose 30-P, 10-P and 10-G campaign finance disclosure reports were filed 36, 53 and 38 days late, respectively.
Facts:
Tammy Lamy states that she has never been involved in campaigning or elections and she didn't have a campaign manager or a campaign team, besides her family to help her. She states that she read all of the campaign rules and thought she understood everything. Her husband decided to do a raffle for a chartered fishing trip as a campaign fundraiser. She put a limit on tickets sold as to not exceed the maximum funds allowed without filing campaign reports. She didn't see a need to raise more than $2,000 - $2,500. In late September, her parents surprised her with signs for her campaign. She and her mother both thought that the signs weren't considered an in-kind donation if received from immediate family so she thought she still didn't have to file campaign finance disclosure reports. In general conversation, days before the election, she mentioned not having to file because the amount she collected was under the maximum allowed. She explained that her parents bought her signs and how thankful she was. Another candidate responded that he thought that it would be considered an in-kind donation. She re-read the financial packet received when she qualified and immediately contacted the Ethics Board to ask and was informed that she would indeed have to claim them as an in-kind donation and file.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed.

18:1495.4D(1) If the final report of a candidate for an election, as required by Paragraph (5), (6), or (7)of Subsection B of this Section, shows a deficit or a surplus, the candidate and his treasurer, if any, shall file supplemental reports with the supervisory committee of all information required in R.S. 18:1495.5. Such reports shall be filed annually no later than February fifteenth and shall be complete through the preceding December thirty-first. Such a supplemental report shall be filed each year until a report has been filed which shows no deficit and until any surplus campaign funds have been disposed of in accordance with R.S. 18:1505.2(I). The report on surplus funds shall disclose the disbursement of such funds in the same manner as expenditures are reported.

Recommendations:
Decline to waive for the 30-P, 10-P and 10-G reports.
