Advisory opinion request as to whether Representative Steve Pugh may be employed by the Louisiana House of Representatives after his term of office as a member of the Louisiana House of Representatives ends.
Facts:
Representative Steve Pugh serves as a member of the Louisiana House of Representatives with his term ending on January 13, 2020. Representative Pugh is considering applying for employment with the Louisiana House of Representatives after his term ends to serve as Capitol Foundation Coordinator selling state souvenirs to members of the legislature, tourists and residents. If the position of Capitol Foundation Coordinator becomes available before Representative Pugh's term ends on January 13, 2020, he will resign before submitting an application for the position.
Law:
La. R.S. 42:1121A(1) prohibits a former agency head or elected official, for a period of two years following the termination of his public service as the head of such agency or as an elected official serving in such agency, from assisting another person, for compensation, in a transaction, or in an appearance in connection with a transaction, involving that agency or rendering any service on a contractual basis to or for such agency.

La. R.S. 42:1121A(2) prohibits a former member of a board or commission from contracting with, being employed in any capacity by, or being appointed to any position by his former board or commission for a period of two years following the termination of his public service on such board or commission.
