Waiver request submitted by Katherine Westerhold regarding a $2500 late fee assessed for filing her La. R.S. 42:1114 disclosure 65 days late.
Katherine Westerhold is the spouse of John White, State Education Superintendent. In October 2017, Mr. White was issued an advisory opinion that advised that his wife was not prohibited from working for a company that had a contractual, financial or business relationship with the Department of Education. However, he was advised that she would be required to file annual financial disclosures pursuant to R.S. 42:1114. He was advised these filings are due annually on May 15.

Ms. Westerhold filed her 2017disclosure on July 19, 2018, 65 days late, and was assessed an automatic late fee of $2500.

La. R.S. 42:1114 provides that each public servant and each member of his immediate family who derives anything of economic value, directly, through any transaction involving the agency of such public servant or who derives any thing of economic value of which he may be reasonably expected to know through a person which (1) is regulated by the agency of such public servant, or (2) has bid on or entered into or is in any way financially interested in any contract, subcontract, or any transaction under the supervision or jurisdiction of the agency of such public servant shall disclose certain information as set forth in Section 1114.
Suspend all based on future compliance with the reporting requirements under the Code of Ethics.
