Advisory Opinion request from Sam Territo, former Director of Facility Services at LSU Baton Rouge.
Facts:
Samuel Territo was employed by LSU as the Director of Facility System in the Facility Services unit at the Baton Rouge campus. Mr. Territo reported to David Maharrey, Executive Director of Facility Services. He retired on February 19, 2019.

Mr. Territo is currently employed by Johnson Controls as an HVAC Truck Base Service Manager. His duties include insuring that mechanics and technicians perform the work as required by client contracts. He is a salaried employee and does not receive commissions.

Johnson Controls has for several years provided HVAC services to LSU through HVAC Service Agreements. As part of his duties for LSU, Mr. Territo administered HVAC services provided by Johnson Controls and other vendors for HVAC work to be performed on LSU's campus.

Mr. Territo asks whether he would be prohibited from providing HVAC services to LSU through his current employment with Johnson Controls. Mr. Territo would be responsible to oversee and insure that the work being performed by Johnson Controls mechanics and technicians is being done in accordance with the HVAC Service Agreements.

Law:
La. R.S. 42:1121B provides that no former public employee shall, for a period of two years following the termination of his public employment, assist another person for compensation in a transaction involving the governmental entity in which the public servant participated during his public employment or render any service which you had rendered during your public employment on a contractual basis to, for, or on behalf of the former agency.
Recommendations:
Adopt the proposed advisory opinion.
