Advisory opinion request as to whether Representative Steve Pugh may be employed by the Louisiana House of Representatives after his term of office as a member of the Louisiana House of Representatives ends.
Facts:
Representative Steve Pugh currently serves as a member of the Louisiana House of Representatives with his term of office ending on January 13, 2020. Representative Pugh is considering applying for employment with the Louisiana House of Representatives after his term of office ends to serve as Capitol Foundation Coordinator selling state souvenirs to members of the legislature, tourists and residents. If the position of Capitol Foundation Coordinator becomes available before Representative Pugh's term ends on January 13, 2020, he will resign before submitting an application for the position.
Law:
La. R.S. 42:1121A(1) provides that no former agency head or elected official shall, for a period of two years following the termination of his public service as the head of such agency or as an elected public official serving in such agency, assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction, involving that agency or render any service on a contractual basis to or for such agency. La. R.S. 42:1121A(2) prohibits a former member of a board or commission from contracting with, being employed in any capacity by, or being appointed to any position by his former board or commission for a period of two years following the termination of his public service on such board or commission.
