Advisory Opinion request from Alicia Kiremire, an Adjunct Instructor in the College of Engineering & Sciences at Louisiana Tech University, whether her company could provide grant-related services to Louisiana Tech University.
Facts:
Alicia Kiremire was employed at Louisiana Tech University from July 2006 until May 2009 in an administrative capacity involving grant-related matters. In August 2014, Ms. Kiremire started FlowStream Management, LLC (FlowStream), a sole-member limited liability company that provides grant writing and management services. During September and October 2017, FlowStream delivered a grant proposal under a contract with Louisiana Tech involving the College of Engineering & Science. In December 2018, Ms. Kiremire became an Adjunct Instructor in the College of Engineering & Science at Louisiana Tech, whose duties included teaching engineering courses but not grant writing or management. FlowStream has been approached by the College of Education at Louisiana Tech to write and/or manage a grant.
Law:
La. R.S. 42:1111C(2)(d) prohibits a public servant and a legal entity in which the public servant exercises control or owns an interest in excess of twenty-five percent, from receiving any thing of economic value for services rendered to or for any person during his public service unless such services are neither performed for nor compensated by any person (1) has or is seeking to have a contractual, business or financial relationship with the public servant's agency; (2) conducts operations or activities that are regulated by the public employees' agency; or, (3) has a substantial economic interest which may be substantially affected by the performance or nonperformance of the public employee's official duty

La. R.S. 42:1113A prohibits a public servant, or member of his immediate family, or legal entity in which he has a controlling interest from bidding on or entering into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of his agency.

Recommendations:
Adopt the draft of the proposed advisory opinion.
