Advisory Opinion request from Mark Ludke, owner of Mark's Driving Academy, LLC and teacher at C.E. Byrd High School in Shreveport, as to whether he can provide private driver education courses to students.
Facts:
Mark Ludke is currently employed as a Civics teacher at C.E. Byrd High School in Shreveport. For the last twelve years, he also taught driver education courses to students at the school. Mark Ludke is also the owner of Mark's Driving Academy.

On May 17, 2019, the Caddo Parish School Board decided to no longer offer driver education courses through the schools, including C.E. Byrd High School, effective July 1, 2019.

Law:
La. R.S. 42:1111C(1)(a) prohibits a public servant from receiving anything of economic value for any service, the subject matter of which is devoted substantially to the responsibilities, programs, or operations of the agency of the public servant and in which the public servant has participated.

La. R.S. 42:1111C(2)(d) prohibits a public servant from receiving anything of economic value for services provided to a person who has substantial economic interests which may be substantially affected by the performance or nonperformance of the public employee's official duty.

In Docket No. 2017-883, the Board concluded that Section 1111C(1)(a) would prohibit Mark Ludke from receiving compensation for providing driver education courses to students at C.E. Byrd High School since driver education courses were offered by the school and he participated in the program in his official capacity. Additionally, the opinion stated that Section 1111C(2)(d) would prohibit Mr. Ludke from receiving compensation from any students he taught at C.E. Byrd High School.


Recommendations:
Adopt the proposed advisory opinion.
